1. Basic Provisions

1.1. 1.3. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

1.4. The controller has not appointed a data protection officer.

2. Sources and Categories of Processed Personal Data

2.1. The controller processes personal data you have provided or personal data obtained by the controller based on the performance of your order.

2.2. The controller processes your identification and contact data and data necessary for the performance of the contract.

3. Legal Basis and Purpose of Processing Personal Data

3.1. The legal basis for processing personal data is:

- Performance of the contract between you and the controller pursuant to Article 6(1)(b) GDPR,

- Legitimate interest of the controller in providing direct marketing (especially for sending commercial messages and newsletters) pursuant to Article 6(1)(f) GDPR,

- Your consent to processing for direct marketing purposes (especially for sending commercial messages and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, if no order of goods or services has been placed.

3.2. The purpose of processing personal data is:

- Processing your order and exercising the rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data necessary for successful order processing (name, address, contact) are required. The provision of personal data is a necessary requirement for concluding and performing the contract. Without providing personal data, the contract cannot be concluded or fulfilled by the controller.

- Sending commercial communications and other marketing activities.

3.3. The controller does not carry out automated individual decision-making within the meaning of Article 22 GDPR.

4. Data Retention Period

4.1. The controller retains personal data:

- For the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years from the end of the contractual relationship),

- Until consent to the processing for marketing purposes is revoked, but no longer than 5 years if the data is processed based on consent.

4.2. After the expiration of the retention period, the controller will delete the personal data.

5. Recipients of Personal Data (Controller’s Subcontractors)

5.1. Recipients of personal data are persons:

- Involved in the delivery of goods / services / execution of payments based on the contract,

- Providing services related to the operation of the e-shop,

- Providing marketing services.

5.2. The controller does not intend to transfer personal data to a third country (outside the EU) or an international organization.

6. Your Rights

6.1. Under the conditions set out in the GDPR, you have:

- The right of access to your personal data pursuant to Article 15 GDPR,

- The right to rectification pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR,

- The right to erasure of personal data pursuant to Article 17 GDPR,

- The right to object to processing pursuant to Article 21 GDPR,

- The right to data portability pursuant to Article 20 GDPR,

- The right to withdraw consent to processing in writing or electronically to the controller’s address or email specified in Article 1 of these conditions.

6.2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

7. Personal Data Security Conditions

7.1. The controller declares that all appropriate technical and organizational measures have been taken to secure personal data.

7.2. The controller has adopted technical measures to secure data storage and storage of personal data in paper form, especially passwords, antivirus software, and backups.

7.3. The controller declares that access to personal data is granted only to authorized persons.

8. Final Provisions

8.1. By submitting an order through the online order form, you confirm that you are familiar with the privacy policy and that you accept it in its entirety.
